Research – Specific Exhibits of Proof

We know for certain that Michael’s father was William Bryant and his mother was Catherine ________, but thus far, no record of marriage has ever been found. This date has been established using the children and estimating backward. There are even no firm birth dates for any of their children; therefore, this date of marriage, nor the place, at best is a wild guess. Please don’t hang your hat on it.

Exhibit A - John Bryan of Isle of Wight 20 Apr 1694 Deed

To all Whereas Now Know ye that I the said Sir Edmond Andros Knt, Governor with the (????) Colony of the Council of State Accordingingly give and grant Unto JOHN BRYAN of the Isle of Wight County Seven hundred and fifty Acres of Land Situate lying and being on the Northwest Side of Sumerton Swamp in Nansemond County beginning at a marked white oak standing on the Westward Side of the aforesaid Swamp being a line tree of MICHAEL KINGS and running (?????) by a very Irregular Line of old Marks (????) of in Kings Northwesterly forty five Degrees here two hundred Ninety pole to an old Corner red oak thence on the aforesaid Course Eighty Two poles further to a marked pine thence Southwesterly Thirty five degrees one hundred Ninety poles to a marked pine thence South Easterly four degrees one hundred Thirty four poles to a Marked pine thence Southwesterly Thirty degrees one hundred two poles to a Marked pine standing Nigh Cardugans line thence South Easterly Twenty five degrees four hundred pole to a Marked tree Standing on Northwestward Side of the Run of Sumerton Swamp bordering on Cardugians Land and including all Tho. Those transported were: Deborah MOUNTFORD, Thomas BARNFORD, Isabell COLLIER, John BUTLER, Elizabeth (HOWARD?), William WILKERSON, and Nine Negroes.

Comment: I think we may find that Michael’s mother may be a daughter of the above Michael King and his father, William Bryant, may be the son of the above John Bryan. Furthermore, I think this John Bryan to be the father of William Bryant (Michael's father), John Bryant JR. Needham Bryant, and Lewis Bryant, who died prior to 1741.
 

19 Dec 1721 ( #1431) William GRAY of Chowan sold to James TURNER of Isle of Wight VA 320 acres on the South Side of the Roanoke River, adjoining River Pocoson, Goose Meadow, John BRYAN and river. Witnessed by: John GRAY, Wm COMRIE, Seth HATCHER.

Comment: It is possible that this John Bryan is the same man who lived beside Michael King back in Nansemond Co., Virginia, as seen above.

18 Jul 1722 (#1468) John NAIRN of Chowan and wife Mary deeded to James ALLEN of Albemarle 100 acres on Pocoson on the South Side of the Roanoke River adjacent to John NAIRN and meadow. Witnesses: John BRYAN, John CORTNEY, Daniel McDANIEL

18 Jul 1722 (#1469) John NAIRN of Chowan Precinct and wife Mary deeded to Daniel McDANIEL of Albemarle 200 acres on the South Side of the Roanoke River adjacent to  Wm DREW, "my own line", Old Field near river bank and river. Witnessed by: John BRYAN, John CORTNEY, James ALLEN

__ ___ 1723 (#2020) John BRYAN SR. 640 acres on the South Side of the Roanoke River adjoining Richard MELTON, Col. Edward MOSLEY, John McDANIEL.

Comment: This particular deed further helps identify this John Bryan as a SR. meaning there was a John Bryan JR. around here, too. Therefore, this John Bryan SR. would be an older man, thus, bolstering my thought that he is the same man who owned property in Nansemond Co., Virginia, in 1694.

__ ___ 1725 (#2339) William BRYAN acquired 50 acres on the North Side of the Roanoke River in Bertie County. Witnesses: R. EVERARD, William REED, C GALE, Lovick MOSELY.

Comment: It is possible that this William Bryan is Michael's father. Whether or not, he actually lived here is still unknown. ACTION: Abstract this 50 acres to see what became of it.

__ ___ 1727 (#2441) William BRYAN acquired 260 acres on the South Side of the Roanoke River adjoining Panther Pocoson, Arthur DAVIS, Cullen POLLOCK, Looking Glass Swp. Witnessed by: R. EVERARD, C. GALE, MOSLEY, SANDERSON.

Comment: Obviously, this is the same William Bryan that acquired the 50 acres on the North Side of the river in 1725 as shown by the preceding document. Thus, it is only speculation, but I believe this William Bryan is the father of Michael Bryant.

__ Aug 1727 (#2430) John BRYAN acquired 112 acres on the Roanoke River adjoining Watery Branch adjacent to Thomas WHITMELL.

ACTION: Obtain the original document to determine which John Bryan and which side of the river.

9 Feb 1730 (C 338) William Bryant to John Veal of Norfolk Co Virginia, 86 acres on the North Side of the Roanoke River and Bridger's Creek, granted 1 Apr 1723 adjacent William Bryant, Timothy Cumingim. Witnessed by: Joseph Sumner, Robert Braswell.

Comment: This document is inserted to show another William Bryant whom I believe to be the son of James Bryant. I think this one is married to Mary Bridgers.

14 Sep 1734 John BRYANT Edgecombe County Will

Dated: 14 Sep 1734. Probated: May term of Court 1735  "...being very weak in body..." Wife, Elizabeth BRYANT, - life estate in Mulatto Bess, iron bed, black walnut safe, chairs, truck, etc. Son William BRYANT - land in the marsh where the line crosses it and then following the water course, also, another tract in Cypress Swamp know as BALLARDS, also another tract on the East Side of Deep Creek on the Indian Path, also another tract on Beaverdam Swamp that leads out of Fishing Creek and known as POLLUCKS Beaverdam, also negroes Robbin and Mingo, bed, black walnut round table, four steer at Conahoe, the rest of my cattle at Conahoe (which he is to divide with John FORTE) etc.

Comment: This is obviously John Bryant JR. From it we can see that his father, John Bryant SR. is no longer living. Also, we learn that John JR. gives his son, William Bryant four separate pieces of land. They are:

  1. Land adjoining the plantation on which John Bryant was living at time of death.
  2. Land in Cypress Swamp known as Ballards.
  3. Land on East Side of Deep Creek on the Indian Path.
  4. Land on Beaverdam Swamp that leads out of Fishing Creek.

It's only a hunch, but I get a feeling that William Bryant, father of Michael Bryant, is a brother to this John Bryant JR.

ACTION: We need to do the following two things:

  1. See how, when and from whom John Bryant JR. obtained these four tracts of land.
  2. Check out any will left by a John Bryant prior to 14 Sep 1734. 

Son Arthur BRYANT - plantation where I now live which adjoins the land given my son, William another, plantation on Deep Creek where Richard CAMP now lives, also 100 acres in Kehucke Swamp, also Negroes Tom, and Kenny, bed, black walnut square table, cattle at the plantation where Richard CAMP lives, to be divided between land I gave to my son William, also twenty pounds paid to me by James BARNES, by note, to be paid at Mr. Theo PUGH.

Friend John FRYE, 100 acres of Kehucke land below the place where Robert WRIGHT now lives.

To James TURNER "living in Virginia" - the remainder of the tract left my son HOPPER (sic). Remaining moveable estate to be divided between my wife and sons William and Arthur.

Executors: sons, Davie HOPPER and William BRYANT Witnessed by Robert ?EDFORD, Archibald THOMPSON and Ann FRAZIER

Comment: I believe this John BRYANTJR. to be an uncle to Michael BRYANT.

Note: John POPE, who is called a friend of John BRYANT, had a son by the name of Barnaby POPE who is mentioned in the will of Barnaby McKINNIE JR., in 1736. John POPE bought land from Barnaby McKINNIE in 1721 and lived on the Maherrin Swamp.

In 1736, at the time of his death, Barnaby McKINNIE JR. lived in Edgecombe County; however, today, it would be Halifax County, very near the old Bryan Graveyard.

Comment: I believe this William BRYAN is the cousin of Michael BRYANT.  

(pg 169) William BRYAN late of Edgecombe Precinct now of Bertie Precinct to James BARNES of Bertie Precinct 15 Aug 1743. 25 pounds VA money 315 acres on the South Side of Moratuck River, adjacent John GRAY and Cypress Swamp. wit: John FLOWERS, W. ROADS, Thom NORFLEET reg Edge Co May Ct 1743, Robert FORSTER county clerk.

Comment by Ken Lindsay: This is an important marker because it shows us that this William Bryan, whom I believe to be a cousin of Michael Bryant, lived in Bertie Precinct 15 Aug 1743, but formerly lived somewhere within the bounds of Edgecombe County as it was in 1743. Here William Bryant is selling the portion of the homeplace he inherited from his father in 1735.

At that time, Edgecombe included all the present counties of Edgecombe, Granville (1746), Bute (1764 and abolished 1779), Warren (1779), Franklin (1779), Nash (1777), Wilson (1855), and parts of Johnston and Wayne Counties.

Comment: Concerning destruction of some Bertie County Records - In Court Minute Book II (Cathy Farris writes, "The last courtroom date Haun entered was 1743 with a court report about the 1741 and 1742 taxes, then the entries jump to an entry that says the following: "430 – Upon information made to the court that the Warehouse at Captain John CAMPBELL’S had been destroyed by a storm..."

Exhibit J - 26 Apr 1757, Deed: H-408 Michael Bryant & Wife to Aaron Ellis 1757

  This is a deed from Bertie Co NC. Brown (Bryant) et uxor to Ellis. To all People to whom these presents shall come Greeting to know ye that I Mical Bryan and Olive his wife of Bertie County within his Magesty's Province of North Carolina for and in consideration of the sum of eleven pounds current money of Virginia to me in hand paid before the ensealing here of well and truely paid by Aaron Ellis the receipt whereof. I do hereby acknowledge and myself therewith fully satisfied and contented and thereof and of every part and parcel thereof, do exonerate acquit and discharge the said Aaron Ellis his heirs & exors, admor forever by these presents, have given granted sold aligned conveyed & confirmed and by these presents freely fully and absolutely grant bargain sell alien convey and confirm unto him the said Aaron Ellis his heirs and assigns forever and messuage or tract of land situate lying in Bertie County of North Carolina containing 100 acres of land joining to Robert Hodges Patent line and South West to a corner forked Spanish Oak thence East to Little Roquist. To have and to hold the said granted and bargained premises with the Appertueances Priviledges & Commodities to the same belonging & in any wise appertaining to him the sd. Aaron Ellis his heirs & assigns forever to his and their only proper use benefit and behoof forever, And the said Mical Bryan and Olive his wife for themselves their heirs exors, and admon. do covenant promise and grant to & with the said Aaron Ellis his heir & assigns that before the exealing hereof, I am the true sole & lawful owner of the above bargained premisesAnd am lawfully seized and possessed of the same in my own proper right as a good perfect and absolute estate of Inheritance in fil simple and have in myself good right full power and lawful authority to grant bargain sell convey and confirm said bargained premises in manner as abovesaid, And that the said Aaron Ellis & his heirs and assigns shall and may from time to time and at all times forever hereafter by force and virture of these presents lawfully peaceably and quietly have hold use occupy possess and enjoy the said demised and bargained premises with the appurtenances free & clear, and freely and clearly acquitted exonerated and discharged of from all and all manner of former another gifts grants bargains sales leases mortgages will initails joyntures dowers, judgements executions incumbrances and extents; furthermore I the said Michal Bryant and Olive his wife for ourselves our heirs exors, admors, do covenant and engage the above demised premises to him said Aaron Ellis his heirs against the lawfull claims or demands of any person or persons whatsoever forever hereafter to warrant secure and defend. In witness whereof, we hereunto sett our hands and fix our seals this 26th day of April 1757. Mical Bryan seal Olliff Bryan. Signed sealed and delivered in the Presence of James Abington, Elias F. Hodges & Bertie County s.s. April Court 1757. The witin deed of sale was in open court duly proved by the oath of James Abington, an evidence thereto, and on motion was ordered to be registered. Test. Benj. Wynns Clerk Cur.

Comment: This deed, in my opinion, can lead to the proof of parents of Michael Bryant. From the wording, we can see that this is an estate in land which has the potential of lasting forever (Fee Simple). The 100 acres includes a house (Messuage). Appurtenance means something, which belongs to something else. In this case, a land deed, it might refer to rights-of-way, houses, barns, outbuildings, gardens, orchards, fences, crops, or anything else that belongs to the land.

The deed spells out very clearly that Olive relinquishes her dower right and she signs the deed. (This common-law-dower was in effect up until 1784 in North Carolina.)

From the legal description, we know this 100 acres adjoins "Robert Hodge’s "patent line" (which means it is outside Hodge’s patent) and South West to a corner forked Spanish Oak thence East to Little Roquist." Little Roquist, in my opinion, means a small branch off the main body of Roquist Creek and that this 100 acres lay to the West of that branch and East of Robert Hodge’s Patent. This pretty well defines the location of this property and following this lead, it would help tremendously if we can determine who were the owners of this land previous to 1756.

It is much to early to tell how this 100 acres was acquired by Michael Bryant and Olive ________; however, I feel from the land records we already have will show us who owned this property previous to Michael and Olive. That knowledge should give us some idea where to search in the North Carolina State Archives.

If you recall, many years after William Bryant died, Catherine appealed to the Court, "Humbly showeth Katherine Ellis that she humble pedE? Is EnEp? Of the last will and Testament of William Bryan Dec’d. and since been married to Aaron Ellis who is also Dec’d, and it is thus as to the estate of William Bryan Dec’d. he had four sons (she means living… Jesse has died) whose tho some of them rec’d part of what accrued (was given or fell) to them from their Dec’d father’s Estate. Yet there remains balances due some of them…….."

Since Catherine says some of them have already received their share, and others have not, leads me to think that Michael was one of those who received his share. Could this 100 acres, including a house, be that share of his father’s estate?

Haun - Bertie County Court Min Book III:

1771 Solomon ABEL orphan of Bathia be bound to William BRYAN til 21 and learn the art of cordwainer.

1771 – After William BRYANT died in 1744, his widow, Catherine (_________) BRYANT married Aaron ELLIS. Then, upon Aaron ELLIS’ death, she discovered that William BRYANT’S estate had never been legaly settled. Therefore, before she could settle the Aaron ELLIS estate she must settle William BRYANT. To start the process she petitioned the Bertie County Court:

"To the Worshipfull Court of Bartie
"Humbly showith Katherine ELLIS that your humble pedE is EnEp of the last will and Testament of William BRYAN Dec'd and has since been married to Aaron ELLIS who is also Dec'd, And it is thus (as to the Estate of Wm BRYAN Dec'd he had four Sons, Whoz tho Some of them has rec'd part of what Accrewed to them from their Dec'd father's Estate. Yet there Remains Balaces Due to Some of them.

"And he he had also two Daughters (the Estate By Indolence and neglect of my sake or lack or last Husband has been UnSettled or Auditted, and my my Selfe being but a weake woman in affairs of this Kind Humbly prays your worships will Order or Appoint Some proper persons to Make Audit and Sell the same.

"To the Intent I may be Enabled to make a Just and True Inventory of my Last Deceased Husbands Estate When my former Husbands is Settled and the Debts paid off."

Jess HARRELL, Peter SMITH, Thomas HOUSE, and Joseph GARDNER met "In Obedience to an Order of the worshipful Court of Bertie County," did "meet, settle and divide the Estate of William BRYANT, deceased equally, and impartially among the several representatives, given under our hand the day and year above written."

Microfilm #1672531 Estate of Bertie Co., North Carolina reads, "In obedience to court the subscribers did settle the Estate of William BRYAN, deceased equal and impartial among his several representatives under our hand" signed by Jesse HARRELL, Peter SMITH, Thomas HOUSE and Joseph GARDNER.

I arrived at this year of birth using the 1790, 1800 Federal Census Records of Bertie Co., North Carolina and the1820 Census of Jefferson Twp., Pike Co., Indiana, and his father’s will record as follows:

25 Apr 1794, Will: #231 Bertie Co., North Carolina – Mikel Bryan.

Exhibit 77 – (Proof of Needham Bryant’s parents comes from his father’s will dated 25 Apr 1794 and proven in May Term of Court in Bertie Co., North Carolina. An abstract of this will tells us.)

"In the name of God amen I Mikel BRYAN of the County of Bertie and province of North Carolina being afflicted with bodily pain though sound and perfect mind and memery thanks be given to God by calling ti mine the mortality of mankind and knowing it to appoint this my last will and testament in the following manner to wit:

Item - I tend unto my beloved wife Olive BRYAN all of my plantation, hereon I now live during her natural life. Also I tend to my beloved wife Olive BRYAN one pot and one frying pan and all my pewter. Two cows and calves during her natural life.

Item - I give and bequeath unto my son Neadom BRYAN after the deseas of my beloved wife, all my land and plantation whereon I now live, to him, his heirs and assigns forever.

Item - I tend to my beloved wife Olive BRYAN one mare and colt during her natural life and after the desease of my beloved wife, I do hereby give and bequeath the said mare and colt to my son Neadom BRYAN to him and his heirs and assignees forever.

Item - I tend to my beloved wife two sows and nine pigs during her natural life.

Item - I give unto my son Nedam BRYAN to him his heirs and assignes forever two sows and fourteen pigs and two shoates.

Item - I give unto my daughter Marthew BRYAN one sow and four pigs to her heirs and assignees forever.

Item - I give unto my daughter Marthew one loom, __?____ and after the decease of my beloved wife I give unto my daughter Marthew BRYAN one feather bed and furniture to her heirs and assignees forever.

Item - I give unto my son Neadom BRYAN two __?__ and one pair of iron wedges one graveling hoe and three wedging hoes to him his heirs and assigns forever.

Item - I give unto my daughter Marthew BRYAN one looming and one wooling wheel and one pair of cards and one ___?___ to her and her heirs and assigns forever.

Item - I tend to my beloved wife Olive BRYAN one table and six chairs three washing tubs two pigens and one ans all my Barrells during her natural life.

Item - and after the decease of my beloved wife I do give and devise all of my Estate before mentioned to be equally divided between my two children mentioned, Neadom BRYAN and Marthew BRYAN, to them their heirs and assigns forever ... and likewise a parcel of Earthenware.

Item - I Leave all the remainder part of my Estate to be sold after paying all my debts, the remainder part to be equally divided between my six children, Jesse BRYAN, Elisha BRYAN, Mikel BRYAN, Neadom BRYAN, Sarah HARRELL, and Marthew BRYAN to them and their heirs and assigns forever.

Needham was 26 years old and still single and his mother, Olive ________, who is estimated to have been born about 1733, would have been 67 years old when the census was taken. Also, she is thought to have died before the 1810 census as neither she nor Needham appear to be living in Bertie County, although they still owned 143 acres left to them by the father and husband, Michael Bryant.

Comment: This John BRYAN may be a son of William and Catherine. If so, it certainly gives a close link to the Lewis Bryan bunch. George Lockhart is a proven spouse of Mary Bryan as shown in the following:

Exhibit 48 presents selected pages (including the front cover and the certification at the end) that show land entries made by Michael Bryan (No. 32), Silus Smith (No. 187), and Michael Bryan (No.203). According to Samuel Robert Shi III, a professional genealogist hired by Cathy Farris, "Silus’ entry would appear to be related to the caveats entered against the other entries. (Often, one can assume that the signatures in an entry book are those of the party making the entry. Since the certification at the end says that this is a copy of the Land Entry Book, this may not be the case, here."

Exhibit 48A presents a copy of the "shuck" (envelope) used to contain other papers associated with Entry No. 32. According to Mr. Samuel Robert Shi III, "This shuck and its contents were filed under File Number 1047 of the Secretary of State Land Office papers for Bertie County. It seems clear that, for Entry Number 32, Michael Bryant entered for 200 acres but, due to the caveats ended up with 143 acres. (See the warrant dated 1 September 1779 and the survey dated 3 October 1781 below. The record of the Bertie County deed associated with this grant is found below among the 1789 records. I did not consult Land Grant Book 72 for another legal description of this land."

Exhibit 49 presents selected pages (including the certification at the end) that shows a land entry made by William Rasco (No.93) for 200 acres of land lying on Roquist Pocoson that mentions Mikal Bryan’s line and others. Again, the signatures may not be those of the original parties.

Exhibit 57 contains an agreement by William Freeman to a border between his land and that of Noah Hinton. The agreement is signed by Thomas Pugh, Matthew Turner (by Mark) and William Pugh. (It is not signed by William Freeman and Noah Hinton.) This land is near the head of Roquist Pocoson. Exhibit 63 is the survey for Michael Bryan’s Land Entry Number 32 (dated 13 May 1778). This land is said to be on the North Side of Allagator Marsh and Pocoson. The survey begins in William Freeman’s Line and adjoins Cyprus Branch, Cylus Smith. "old patent corner standing on Little Roquist Swamp", and William Ruffin. Chain carriers were Jesse Bryan and John Gardner. Wife - Sarah GARDNER - plantation where we now live and all perishable estate for her lifetime.

(There may be more information concerning this among the court records.) This paper was filed with a much older William Bryan records in a folder named "William Bryan." (Note: This is William Bryant Sr., father of Michael Bryant.) Action: We need further investigation of this folder named "William Bryan." Item - I tend unto my beloved wife Olive BRYAN all of my plantation, hereon I now live during her natural life. Also I tend to my beloved wife Olive BRYAN one pot and one frying pan and all my pewter. Two cows and calves during her natural life.

Item - I give and bequeath unto my son Neadom BRYAN after the deseas of my beloved wife, all my land and plantation whereon I now live, to him, his heirs and assigns forever.

She may have accompanied her son, Needham, into Georgia, where you could get free Lottery Land if lucky.

Exhibit 83 presents the court order that Aaron Spivey, John Pugh, John Hill and Jesse Rhodes allot and layoff to Elizabeth Bryan and children "such part of the crop, stock & provisions" of William Bryan’s estate that will be adequate for their support for one year. It also presents the statement of the year’s provisions supplied by the same men. ("Deed of Gift: Elizabeth Bryan to Elizabeth Adams", Miscellaneous Land Records 1720-1861, C.R.010.408.3, Folder "Deeds of Gift A-W", Original Bertie County (NC) Records, North Carolina State Archives, Raleigh, North Carolina.

Note: I’m sure it wasn’t long after his mother’s death that Needham Bryant, along with other neighbors, relatives and friends went down into the Georgia Province. Unfortunately, the 1810 Census for Georgia does not exist. The best source of information during this period comes from the Land Lottery and Tax Lists.
